 Dubai | Fetus Dies Due to Medical Malpractice, Doctors and Nurses Ordered to Pay 200,000 Dirhams Compensation



Due to the death of a fetus inside the mother's womb caused by medical malpractice, the Dubai Civil Court has ordered two doctors and two nurses from a private hospital to jointly pay 200,000 dirhams in compensation.

The court ruled that these doctors and nurses committed serious medical errors and must pay court fees and related expenses. From the date the ruling becomes final until full settlement, they must also pay statutory interest of 5% on the compensation amount.

Previously, an Arab couple filed a lawsuit after losing their child, demanding 499,000 dirhams in compensation from the hospital to cover their economic losses and physical and mental harm.

Case records show that the woman had been under continuous medical supervision at this private hospital throughout her pregnancy. However, due to negligence by the doctors and nurses during the delivery process—especially failing to monitor the fetal heart rate and respond to warning signs—the baby died in the womb.

The couple subsequently filed a complaint with the Dubai Health Authority's Medical Liability Committee, which found that the hospital staff did not follow standard procedures and committed serious medical errors.

When the defendants appealed, the Senior Medical Liability Committee upheld the initial investigation findings. The committee concluded that each of the two doctors and two nurses bears 25% responsibility.
